The statutory authority for applying the Simplified Procedures for Commercial Items of FAR 13.5 is 41 U.S.C. § 1901 and is implemented by FAR 13.106-1(b)(2) for restricting competition on this procurement. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable: NA, Sole Source requirement Determination by the CO that the Anticipated Cost to the Government will be Fair and Reasonable: It is anticipated that the cost of this requirement to the Government will be fair and reasonable based on the fact that the San Diego VA is being offered the same price for the Vkeys and the price historically has not changed from the MPLS VA s purchases on credit card. Description of the Market Research Conducted and the Results, or a Statement of the Reasons Market Research Was Not Conducted: Vetbiz was searched using NAICS 334510 430 SDVOSBs results returned. No other market research conducted as Vektor Medical retains the ability to be the Sole Source for this equipment. A Notice of Intent will be posted to confirm market research. Any Other Facts Supporting the Use of Other than Full and Open Competition: None Listing of Sources that Expressed, in Writing, an Interest in the Acquisition: None. A Statement of the Actions, if any, the Agency May Take to Remove or Overcome any Barriers to Competition before Making subsequent acquisitions for the supplies or services required: Market research will be conducted for future requirements to determine if any other authorized distributors become available that allow for competition to the maximum extent practicable.
