Description
Amendment 00001 to Solicitation/RFQ 36C26226Q1219 is hereby issued for the purpose of posting the contractor s questions and providing the Government s responses. We are an SBA VetCert-verified SDVOSB nonmanufacturer. Please confirm whether We may satisfy FAR 52.219-33 and VAAR 852.219-76 by supplying the required products from one or more qualifying United States small-business manufacturers. Compliance with FAR 52.219-33 and VAAR 852.219-76 are determined solely by the contractor s own certification and representation. As the contractor, it is the contractor's responsibility to ensure it meets all requirements of the nonmanufacturer rule and the VA Limitation of Subcontracting. The Government does not advise or confirm how the contractor will meet these requirements. The contractor must certify its compliance with the clause included in the solicitation. The requirement includes two distinct product categories: five therapy chairs and one blanket warming cabinet. Must the actual manufacturer of each product independently qualify as a small business under NAICS 339113, or may the two CLINs be evaluated under different applicable manufacturing NAICS codes? The manufacturer for each CLIN may be evaluated under different applicable manufacturing NAICS codes. May the chair and blanket warmer be manufactured by different qualifying small-business manufacturers while the contractor remains the single SDVOSB prime contractor? Yes. Please confirm the exact manufacturer identity and required country-of-origin/final-assembly evidence for the brand-name PINESTAR/Mirion models 214-210 and PTI-750. The subject solicitation is a brand name or equal requirement. It is the contractor s responsibility to ensure that any product they quote, brand name or equal, complies with all applicable laws and regulations. Does the Government have an SBA class or individual Nonmanufacturer Rule waiver applicable to either CLIN? If so, please identify the covered item. There is no current SBA class or individual Nonmanufacturer Rule Waiver appliable under the assigned NAICS code. Contractors can verify this information independently by reviewing the SBA s Non-Manufacturer Rule Class Waiver List, available on the SBA s website. Please confirm whether technically equal products manufactured in the United States by qualifying small businesses are acceptable when the quotation includes manufacturer literature establishing every salient characteristic.
