Description

The subject requirement is being procured using the Alternative Competition Method in accordance with the Patent and Trademark Office Acquisition Guidelines (PTAG), 78 Fed. Reg. 61185 (October 3, 2013), and the Patent and Trademark Office Efficiency Act (PTOEA) 35 U.S.C. 2(b)(4)(A). As a result of its exemptions, the USPTO is not required to meet the test of full and open competition as defined in FAR Part 6 and may use agency-specific acquisition procedures as described below when the circumstances warrant it and it is in the best interest of the agency to do so. Consequently, USPTO intends to make a sole source BPA Award to support its portfolio-wide real property planning as well as specific GSA consultation support for pending GSA space assignment actions across the USPTO portfolio. After previously posting an RFI (ACQ-27-0182) to sam.gov which closed on 9/24/26, USPTO received 2 legitimate small business responses and have identified FD Stonewater, LLC (FDS); 1001 N. 19th Street, Suite 1401, Arlington, VA 22209; UEI:L26UHZU1XC37 as the contractor able to most likely meet the agency s needs for this requirement. As a result, per (PTOEA) 35 U.S.C. 2(b)(4)(A as further defined in PTAG 6.1.1 (d) USPTO intends to negotiate and award a firm fixed BPA with FDS to meet this requirement. This notice of intent is not a request for competitive proposals, nor will solicitation be issued to the public.
