Please see Attachment 4 for instructions. ******* Posting Type: Combined Synopsis/Solicitation Notice Posting Date: August 7, 2019 Response Date: August 23, 2019 Archiving Date: September 23, 2019 Solicitation Number: 1305M319RNFFP0020 Title: SOUTHERN RESIDENT KILLER WHALE ANNUAL PHOTO IDENTIFICATION SURVEY SERVICES Contract Specialist: Eila Harnett DESCRIPTION (i) This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; proposals are being requested and a written solicitation will not be issued. (ii) This solicitation is issued as a request for proposal (RFP) and has been assigned Solicitation Number 1305M319RNFFP0020. (iii) This solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular No. 2019-02 dated May 6, 2019. (iv) This solicitation is being issued as a full and open competition. The NAICS code for this requirement is 541620 and the small-business size standard is $15,000,000. (v) This combined synopsis/solicitation is for the purchase of the following commercial items: Support services to complete an annual census of the Southern Resident Killer Whale (SRKW) population in the coastal and inland waters of United States and British Columbia, and to provide for the periodic health assessments of this population in accordance with the Performance Work Statement. (vi) The Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA) is seeking sources capable of completing an annual census of the Southern Resident Killer Whale (SRKW) population in the coastal and inland waters of United States and British Columbia, and to provide for the periodic health assessments of this population. (vii) All proposals shall be FOB Destination to NOAA/NMFS/NWFSC, Conservation Biology Division, 2725 Montlake Boulevard East, Seattle, WA 98112. The period of performance is September 15, 2019 to September 14, 2024. (viii) FAR 52.212-1 Instructions to Offerors - Commercial Items (APR 2014) applies to this acquisition. ADDENDUM TO FAR 52.212-1 INSTRUCTIONS TO OFFERORS - COMMERCIAL ITEMS (OCT 2018) Proposals are expected to conform to solicitation provisions and be prepared in accordance with the solicitation instructions. The proposal shall be clearly written and logically presented, with pages of each part appropriately numbered and identifying the solicitation number. There shall be two volumes and each volume shall be clearly marked with the volume number and title. VOLUME 1 - TECHNICAL PROPOSAL While the technical proposal must not contain any reference to price, resource information (such as data concerning labor hours and categories, materials, subcontracts, etc.) may be provided so that the contractor's understanding of the requirement may be evaluated. Technical proposal information will be streamlined and limited to 15 pages. The technical proposal shall clearly demonstrate the offeror's ability to successfully perform the requirements of the Performance Work Statement of Work (PWS). At a minimum, technical proposals shall include the following elements: Technical Capability/Experience addressing: o Corporate experience on contracts similar in type, scope, and complexity of this requirement o Demonstrated understanding of PWS requirements, including identified risks o Demonstrated scientific and technical capability to perform requirements at a high quality o Key personnel proposed roles as they relate to PWS with resumes and letters of commitment o Teaming arrangements or subcontracts and delegation of roles and responsibilities, if applicable, and a plan for managing prime/subcontractor relationship o Management structure, including communication and coordination between all involved parties and roles of the Program Manager The technical proposal shall not exceed 15 pages, using 8.5" by 11" paper and no smaller than Times New Roman size 12 font. Graphics, figures, charts or tables may use size 9 font. Acronym tables, letters of commitment, the Data Management Plan and resumes do not count towards the 15 page count. VOLUME 2 - PRICE PROPOSAL This price proposal shall include details for all resources required to accomplish the requirements, e.g., estimated labor hours and rates, travel (Not to Exceed provided) and other applicable costs. Service rates reflect the fully burdened price per day (DY) including all personnel, material, supplies, equipment, transportation, and facilities (except as otherwise specified). The price proposal shall include a completed Attachment 1 - 1305M319RNFFP0020 SF1449. The proposal shall be consistent with the technical approach and identify labor categories in accordance with the labor categories specified in the PWS. (ix) FAR 52.212-2 Evaluation - Commercial Items (JAN 1999) applies to this acquisition. Paragraphs (a), (b) and (c) are hereby completed as follows: (a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers, with technical capability being equally important as price: (i) Technical capability (ii) Price (b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). (c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. (x) The offeror must submit a completed copy of the provision at FAR 52.212-3 Offeror Representations and Certifications - Commercial Items (MAY 2014) with it's offer. An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically via the SAM website accessed through https://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the SAM website, the offeror shall complete only paragraphs (c) through (o) of this provision. (xi) The clause at FAR 52.212-4, Contract Terms and Conditions - Commercial Items (Deviation 2017-02) (OCT 2018), applies to this acquisition. FAR 52.212-4 CONTRACT TERMS AND CONDITIONS - COMMERCIAL ITEMS (DEVIATION 2017-02) (OCT 2018) (a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post-acceptance rights -- (1) Within a reasonable time after the defect was discovered or should have been discovered; and (2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item. (b) Assignment. The Contractor or its assignee may assign its rights to receive payment due as a result of performance of this contract to a bank, trust company, or other financing institution, including any Federal lending agency in accordance with the Assignment of Claims Act (31 U.S.C.3727). However, when a third party makes payment (e.g., use of the Government wide commercial purchase card), the Contractor may not assign its rights to receive payment under this contract. (c) Changes. Changes in the terms and conditions of this contract may be made only by written agreement of the parties. (d) Disputes. This contract is subject to 41 U.S.C. chapter 71, Contract Disputes. Failure of the parties to this contract to reach agreement on any request for equitable adjustment, claim, appeal or action arising under or relating to this contract shall be a dispute to be resolved in accordance with the clause at FAR 52.233-1, Disputes…
