Description
LIMITED SOURCE JUSTIFICATION PURSUANT TO RFO 12.l02(a) 1. CONTRACTING AGENCY: U.S. Army Corps of Engineers, Seattle District (USACE) 2. DESCRIPTION OF ACTION: Approval is requested to utilize Thrust Masters of Texas (TMOT) to install a new mechanical propulsion assembly within the propulsor of the 42' self-propelled barge Jackson and overhaul the assembly removed from the Jackson to serve as a spare. TMOT is the Original Equipment Manufacturer (OEM) and does not grant license or permission to other vendors to disassemble the propulsion assembly and recommends that a TMOT service technician be present for any work within the propulsor. 3. DESCRIPTION OF SUPPLIES/SERVICES OR NATURE OF CONSTRUCTION: The 25-year-old rotating group on the 42' Jackson vessel is experiencing consecutive propeller seal failures rendering the vessel inoperable. This justification covers the acquisition of one (1) new TMOT Rotating Group (Model B121287), the factory overhaul of the existing Government-furnished legacy rotating group (Model C104916), and the services of an OEMcertified technician to supervise the on-site removal and installation. The total estimated cost of this action is $65,000. Specific services are as follows: Procurement: One new Rotating Group (B121287), shipped to Mud Mountain Dam. Overhaul Service: Complete factory rebuild of the legacy Rotating Group (C104916), including round-trip shipping. Technical Service: On-site supervision by a TMOT-certified technician for three (3) days to oversee the teardown and installation process, ensuring warranty compliance. 4. AUTHORITY CITED: 10 USC 2304(c)(l) and RFO 12.lO2(a) Soliciting from a single source, (i) For purchases not exceeding the simplified acquisition threshold. 5. REASON FOR AUTHORITY CITED: Pursuant to RFO 13.101 (b ), "Contracting officers may solicit from a single source based on a determination and findings (see subpart 1.5) that only one source is reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization). TMOT is the Original Equipment Manufacturer (OEM) of the OD-150 TRNS propulsor unit and its proprietary rotating group assembly. 1. Exclusive Expertise and Proprietary Data: TMOT is the only entity with the proprietary drawings, tooling, and specific expertise required to overhaul the legacy rotating group (C104916) to factory specifications. The manufacturer has stated that a full inspection of the unit housing, prop shaft, and motor, along with the proper pressure and operational tests, can only be performed at their facility. No third-party vendors are licensed or authorized to perform this work. 2. Warranty Preservation: TMOT has stipulated that the warranty for both the new and overhauled units is contingent upon correct installation. LIMITED SOURCE JUSTIFICATION PURSUANT TO FAR 13.l0l(a) FAIR AND REASONABLE COST DETERMINATION: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable based on publicly-available pricing data and available historical prices paid for the same or similar item. APPROVAL Based on the foregoing justification, I hereby approve the procurement of services to operate the smolt trap on the Green River on an other than full and open competition basis pursuant to RFO 12.102 (a) Restricting competition "For acquisitions valued at or below the simplified acquisition threshold(SAT), the decision must be documented that only one source is available and the basis for the decision.
