Description

Notice of Intent to Sole-Source: The 4th Contracting Squadron at Seymour Johnson AFB, NC intends to award a non-competitive firm fixed priced purchase order to Kaeser Compressors. This requirement is to perform preventative maintenance on preexisting Kaeser SK15T. The statutory authority permitting other than full and open competition for this acquisition is 10 U.S.C. 2304(c)(1) and RFO Part 12.102(a). The Kaeser SK15T system at Seymour Johnson AFB is a critical life-support asset producing breathing air that must strictly adhere to OSHA 29 CFR 1910.134 Grade D air quality standards. Kaeser Compressors is the Original Equipment Manufacturer (OEM) of the installed SK15T system. The required maintenance services are highly specialized and unique to the OEM's strict engineering tolerances. The maintenance procedures require proprietary OEM calibration protocols and specialized, certified testing equipment to ensure zero contamination of breathing air. Non-OEM certified technicians do not possess the proprietary testing instrumentation required to validate air safety limits post-maintenance. The SK15T system utilizes the proprietary Kaeser SIGMA CONTROL 2 micro-processor controller. Access to system diagnostics, proprietary firmware updates, alarm history decryption, and system parameter resets requires Kaeser-proprietary software and diagnostic interface tools. Kaeser Compressors does not license or distribute this diagnostic software or its access keys to unauthorized third parties. Without this access, a third-party vendor cannot perform required system diagnostics, safety-interlock testing, or clear maintenance faults. Preventative maintenance on the SK15T requires adherence to proprietary engineering tolerances, belt tension specifications, and internal heat exchanger clearance levels. These specific tolerances are proprietary intellectual property of Kaeser Compressors and are not published in public service manuals. Only factory-trained OEM technicians have authorized access to current, unredacted engineering drawings and technical data sheets required to execute these precise alignments. To ensure equipment safety and prevent catastrophic failure of life-support equipment, it is critical that the OEM or OEM-authorized technicians perform this maintenance. Utilizing unauthorized third-party vendors poses an unacceptable safety risk to personnel due to the potential use of non-compliant parts and uncertified technical procedures. The Government will not be responsible for any cost incurred in preparation of responses to this notice. A determination by the Government to compete this proposed contract, based upon responses to this notice, is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. See the attached Performance Work Statement (PWS) for additional information. THIS IS NOT A REQUEST FOR COMPETITIVE OFFERS and a solicitation will not be issued. All responsible sources may submit a capability statement, proposal, or quotation, which shall be considered by the agency. Any response to this notice must show clear and convincing evidence that competition of this requirement would be advantageous to the Government.
