Contractors must be OEM authorized dealers, distributors, or resellers, verified by an authorization letter or equivalent documentation, ensuring that OEM warranty and service requirements are maintained. All software licensing, warranties, and services must comply with OEM terms and conditions. Delivery of gray market items constitutes a breach of contract. The VA reserves the right to enforce contractual remedies, including contract termination or requiring replacement of gray market or remanufactured items at no cost to the Government. This notice does not obligate the Government to award a contract or pay for information provided in response. The Government may use information received for any purpose deemed legally appropriate.
