Description

DOIAFBO260071 NOTICE OF INTENT TO AWARD A SOLE SOURCE CONTRACT. THIS IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. The United States Department of the Interior (DOI), Bureau of Indian Affairs (BIA), Southwest Regional Office (SWRO), Mescalero Agency, intends to enter into a Sole Source Firm-Fixed Price contract with the Mescalero Gas Company, a Tribally Owned Large Business. The Mescalero Agency requires 15,000 gallons of propane to be delivered to three locations to ensure uninterrupted service and functionality at these facilities: the BIA Law Enforcement building, the BIA Mescalero Agency building and the OJS Mescalero Adult Detention Center. On 21 November 2019, the Mescalero Apache Tribe passed Resolution 19-140. This resolution established Mescalero Gas Company as the exclusive provider of propane on the Mescalero Apache Indian Reservation. Furthermore, it prohibits any non-tribal propane company from entering the reservation to supply propane. Due to the restrictions imposed by the tribal resolution, the requirement for propane delivery will be awarded as a sole source contract under the authority of FAR 6.103-1 Only one responsible source and no other supplies or services will satisfy agency requirements. No solicitation is available and no technical questions will be answered for this requirement. The NAICS code for this acquisition is 325120 Industrial Gas Manufacturing, and the Business Size Standard is 1,200 employees. If a firm believes that BIA should not pursue this procurement, it should submit a capability statement and pricing information for this requirement by 17 June 2026, 12:00 Pacific Time.
