Amendment 1. The purpose of this amendment is to revise the solicitation to incorporate the updated Statement of Work (SOW). The revised SOW is incorporated into the notice as Attachment 1. "Statement of Work (Revised). NON-COMPETITIVE COMBINED SYNOPSIS / SOLICITATION Title: Annual Service Maintenance Contract for BD LSRFortessa Serial # H5B200003 This is a combined synopsis/solicitation for commercial products or commercial services prepared in accordance with part 12. This announcement constitutes the only solicitation. Offers are being requested and a separate written solicitation will not be issued. NON-COMPETITIVE Solicitation number 75N98026Q00660 is issued as a request for quotation (RFQ) for maintenance and service for Government-Owned BD LSR Fortessa Cell Analyzer (Decal# 01825187, Serial # H5B200003) This solicitation incorporates provisions and clauses by reference. The full text of provisions and clauses may be accessed electronically at www.acquisition.gov. THIS IS A NON-COMPETITIVE (NOTICE OF INTENT) COMBINED SYNOPSIS SOLICITATION TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT PROVIDING FOR FULL AND OPEN COMPETITION (INCLUDING BRAND-NAME). The Office of Mission Acquisition Solutions (OMAS), Office of Acquisition (OA), on behalf of the National Institutes of Health (NIH), National Cancer Institute (NCI), intends to negotiate and award a purchase order without providing for full and open competition (including brand-name) to BD, 155 North McCarthy Blvd. Milpitas, CA 95035 for maintenance and service of Government-Owned Becton Dickinson and Company LSRFortessa Cell Analyzer. This acquisition is conducted as non-competitive for a commercial product or commercial services and is conducted pursuant to FAR 12.201-1, Simplified Procedures in accordance with 41 U.S.C. 1901. This requirement is for the following services: Maintenance and Service Contract for Government-Owned Becton Dickinson and Company (BD Biosciences) Company LSRFortessa Cell Analyzer as detailed in the Statement of Work. See the attached Statement of Work Attachment 1. (iii) Description of requirement: The Contractor shall provide all labor, material, and equipment necessary to maintain and provide preventive maintenance for the BD equipment listed above with three lasers (Blue, Red and Ultraviolet) and one FACStation. See the attached Statement of Work Attachment 1. Period of Performance The Government anticipates award of a firm fixed-price purchase order for this acquisition, and the anticipated period of performance is 08/01/2026 07/31/2027. (v) The provisions at FAR 52.252-1, Solicitation Provisions Incorporated by Reference (Feb 1998), applies to this acquisition. This solicitation incorporates one or more solicitation provisions by reference, with the same force and effect as if they were given in full text. Upon request, the Contracting Officer will make their full text available. The offeror is cautioned that the listed provisions may include blocks that must be completed by the offeror and submitted with its quotation or offer. The following FAR clauses are required as applicable to this requirement and incorporated by reference: See Attachment 2- Table# 12-2 FAR 52.222-48, Exemption from Application of the Service Contract Labor Standards to Contracts for Maintenance, Calibration, or Repair of Certain Equipment-Certification (DEVIATION) (RFO Nov 2025) FAR/HHSAR PROVISIONS/CLAUSES FULL TEXT-ADDITIONAL TERMS AND CONDITIONS The following provisions/clauses and additional terms and conditions apply to this acquisition and are provided in FULL TEXT. 352.203-70 Anti-Lobbying (DEC 2015) Pursuant to the HHS annual appropriations acts, except for normal and recognized executive-legislative relationships, the Contractor shall not use any HHS contract funds for: (a) Publicity or propaganda purposes; (b) The preparation, distribution, or use of any kit, pamphlet, booklet, publication, electronic communication, radio, television, or video presentation designed to support or defeat the enactment of legislation before the Congress or any State or local legislature or legislative body, except in presentation to the Congress or any state or local legislature itself; or designed to support or defeat any proposed or pending regulation, administrative action, or order issued by the executive branch of any state or local government, except in presentation to the executive branch of any state or local government itself; or (c) Payment of salary or expenses of the Contractor, or any agent acting for the Contractor, related to any activity designed to influence the enactment of legislation, appropriations, regulation, administrative action, or Executive order proposed or pending before the Congress or any state government, state legislature or local legislature or legislative body, other than for normal and recognized executive-legislative relationships or participation by an agency or officer of a state, local, or tribal government in policymaking and administrative processes within the executive branch of that government. (d) The prohibitions in subsections (a), (b), and (c) above shall include any activity to advocate or promote any proposed, pending, or future federal, state, or local tax increase, or any proposed, pending, or future requirement for, or restriction on, any legal consumer product, including its sale or marketing, including, but not limited to, the advocacy or promotion of gun control. (End of clause) EVALUATION The provision of the FAR 52.212-2, Evaluation Commercial Products and Commercial Services (DEVIATION) (RFO AUG 2025), applies to this acquisition. The Government will award a contract resulting from this solicitation to the responsible Offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors will be used to evaluate offers: a) Technical capability of the item offered to meet the Government requirement; b) Price; and c) Past performance Technical and past performance, when combined, are significantly more important than cost or price. Notice of award. A written notice of award or acceptance of an offer furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award. A determination by the Government whether to compete this proposed contract based upon responses to this notice is solely within the discretion of the Government.
